Article XIII.
Stopping, Standing or Parking Prohibited in Specified Places
Sec. 19-327.
Parking not to obstruct traffic.
No person shall park any vehicle upon a side street in such a manner or under
such conditions as to leave less than ten (10) feet of width of the roadway for free
movement of vehicular traffic, nor shall he park upon any "through Street" in
such a manner or under such conditions as to restrict the operation of the normal moving
traffic lanes on said street, excepting as outlined in section 19-358 of this chapter.

Sec. 19-328. Stopping,
standing and parking in alleys.
No person shall park a vehicle within an alley in such a manner or under such conditions
as to leave available less than ten (10) feet of the roadway for the free movement of
vehicular traffic, and no person shall stop, stand or park a vehicle within an alley in
such position as to block the driveway entrance to any abutting property.

Sec. 19-329. All night
parking prohibited.
(a) No person shall park a vehicle on any street or in municipal parking lots between the
hours of 12:01 a.m. and 6:00 a.m. of any day, from November 1st to April 30th, except
emergency vehicles or physicians on emergency calls. Vehicles which are parked or allowed
to stand in violation of this section shall be towed or hauled away at owner's expense.
(b) The city council hereby authorizes the city manager to issue a certain number of
seasonal overnight parking permits for municipal lot spaces, and to set a fee for such a
permit. Any changes in the number of spaces and/or the fee for the spaces shall be
established by the city manager and approved by the city council. Permit holders shall be
responsible for snow removal for their assigned space. Permit holders must maintain
liability insurance holding the city harmless from use of the spaces, and shall file a
certificate of insurance with the city.
Sec. 19-330. Parking upon
roadways or municipal parking lots for certain purposes prohibited.
No peron shall park a vehicle upon any roadway or municipal parking lots for the principal
purpose of:
(1) Displaying such a vehicle for sale;
(2) Washing, greasing or repairing such vehicle except repairs necessitated by an
emergency.

Sec. 19-331. Parking
adjacent to schools.
(a) The traffic engineer is hereby authorized to erect signs indicating no parking upon
either or both sides of any street adjacent to any school property when such parking
would, in his opinion, interfere with traffic or create a hazardous situation.
(b) When official signs are erected indicating no parking upon either side of a street
adjacent to any school property as authorized herein, no person shall park a vehicle in
any such designated place.

Sec. 19-332. Parking
prohibited on narrow streets.
(a) The traffic engineer is hereby authorized to erect signs indicating no parking upon
any street when the width of the roadway does not exceed (20) feet, or upon one side of a
street as indicated by such signs when the width of the roadway does not exceed (30) feet.
(b) When official signs prohibiting parking are erected upon narrow streets as authorized
herein, no person shall park a vehicle upon any such street in violation of any such sign.

Sec. 19-333. Standing or
parking on one-way streets.
The traffic engineer is authorized to erect signs upon the left-hand side of any one-way
street to prohibit the standing or parking of vehicles, and, when such signs are in place,
no person shall stand or park a vehicle upon such left hand side in violation of any such
sign.

Sec. 19-334. Standing or
parking on one-way roadways.
In the event a highway includes two (2) or more separate roadways and traffic is
restricted to one direction upon any such roadway, no person shall stand or park a vehicle
upon the left-hand side of such one-way roadway unless signs are erected to permit such
standing or parking. The traffic engineer is authorized to determine when standing or
parking may be permitted upon the left-hand side of any such one-way roadway and to erect
signs giving notice thereof.

Sec. 19-335. Stopping,
standing or parking in places which would cause hazardous conditions or traffic
congestion.
(a) The traffic engineer is hereby authorized to determine and designate by proper signs
placed not exceeding one hundred (100) feet in length, in which the stopping, standing or
parking of vehicles would create an especially hazardous condition or would cause unusual
delay to traffic.
(b) When official signs are erected at hazardous or congested places as authorized herein,
no person shall stop, stand, or park a vehicle in any such designated place.

Sec. 19-336. Stopping,
standing and parking on sidewalks.
No person shall stop, stand or park a vehicle on any public sidewalk.

Sec. 19-337. Parking with
left side to curb prohibited.
No vehicle shall stop or park with its left side to the curb. This section shall not apply
to those streets used as a one-way street.

Article XIV. Stopping,
Standing and Parking for Loading and Unloading Only
Sec. 19-358. Traffic
engineer to determine, designate curb loading zones; double parking; delivery vehicles to
use available curb space and obey parking regulations.
The traffic engineer is hereby authorized to determine the location of passenger and
freight curb loading zones and shall place and maintain appropriate signs indicating the
same and stating the hours during which the provisions of this section are applicable.
Excepting that in the central business district, delivery vehicles may double park to make
deliveries to those commercial establishments not having loading zones on "though
streets" or rear entrances. Such deliveries shall be made by licensed carriers and be
not more than ten (10) minutes in duration. However, when adequate curb space is available
near the entrance of suchan establishment, the delivery vehicles shall park in this space
and obey the parking regulations in effect at that location.

Sec. 19-359. Permits for
curb loading zones.
The traffic engineer shall not hereafter designate or sign any curb loading zone upon
special request of any person unless such person makes application for a permit for such
zone and for two (2) signs to indicate the ends of such zone. The traffic engineer upon
granting a permit and issuing such signs may, by general regulations, impose conditions
upon the use of such signs and for reimbursement of the municipality for the value thereof
in the event of their loss or damage and their return in the event of misuse or upon
expiration of a permit. Every permit shall expire at the end of each calendar year.

Sec. 19-360. Stopping,
standing or parking in passenger curb loading zones.
No person shall stop, stand or park a vehicle for any purpose or period of time other than
for the expeditious loading or unloading of passengers in any place marked as a passenger
curb loading zone during hours when the regulations applicable to such curb loading zone
are effective, and then only for a period not to exceed three (3) minutes.

Sec. 19-361. Stopping,
standing or parking in curb loading zone.
No person shall stop, stand or park a vehicle for any purpose or length of time other than
for the expeditious unloading and delivery or pick-up and loading of materials in any
place marked as a curb loading zone during hours when the provisions applicable to such
zones are in effect. In no case shall the stop for loading and unloading of materials
exceed thirty (30) minutes.

Sec. 19-362. Traffic
engineer to establish public carrier stops and stands; signs required.
The traffic engineer is hereby authorized and required to establish bus stops, bus stands,
taxi stands and stands for other passenger common-carrier motor vehicles on such public
streets in such places and in such number as he shall determine to be of the greatest
benefit and convenience to the public, and every such bus stop, bus stand, taxicab stand
or other stand shall be designated by appropriate signs.

Sec. 19-363. Stopping,
standing and parking of buses and taxicabs regulated.
(a) The operator of a bus shall not stand or park such vehicle upon any street at any
place other than a bus stand so designated as provided herein.
(b) The operator of a bus shall not stop such vehicle upon any street at any place for the
purpose of loading or unloading passengers other than at a bus stop, bus stand or
passenger loading zone so designated as provided herein, except in the case of any
emergency.
(c) The operator of a bus shall enter a bus stop, bus stand or passenger loading zone on a
public street in such manner that the bus when stopped to load or unload passengers or
baggage shall be in a position with the right front wheel of such vehicle not farther than
eighteen (18) inches from the curb and the bus approximately parallel to the curb so as
not to unduly impede the movement of other vehicular traffic.
(d) The operator of a taxicab shall not stand or park such vehicle upon any street at any
place other than in a taxicab stand so designated as provided herein. The provision shall
not prevent the operator of a taxicab from temporarily stopping in accordance with other
stopping or parking regulations at any place for the purpose of and while actually engaged
in the expeditious loading or unloading of passengers.

Sec. 19-364. Restricted use
of bus and taxicab stands.
No person shall stop, stand or park a vehicle other than a bus in a bus stop, or other
than a taxicab in a taxicab stand, when any such stop or stand has been officially
designated and appropriately signed, except that the driver of a passenger vehicle may
temporarily stop therein for the purpose of and while actually engaged in loading or
unloading passengers when such stopping does not interfere with any bus or taxicab waiting
to enter or about to enter such zone.

Article XV. Stopping,
standing or parking restricted or prohibited on certain streets
Sec. 19-386. Application of
Article
The provisions of this article prohibiting the stopping, standing or parking of a vehicle
shall apply at all times or at those times herein specified or as indicated on official
signs except when it is necessary to stop a vehicle to avoid conflict with other traffic
or in compliance with the directions of a police officer or official traffic-control
device.

Sec. 19-387. Regulations not
exclusive.
The provisions of this article imposing a time limit on parking shall not relieve any
person from the duty to observe other and more restrictive provisions prohibiting or
limiting the stopping, standing or parking of vehicles in specified places or at specified
times.

Sec. 19-388. Parking
prohibited at all times on certain streets.
When signs are erected giving notice thereof, no person shall park a vehicle at any time
upon any of the streets described in Schedule D of this chapter.

Sec. 19-389. Parking
prohibited during certain hours on certain streets.
When signs are erected in each block giving notice thereof, no person shall stop, stand or
park a vehicle between the hours specified in Schedule D of this chapter of any day except
Sundays and public holidays within the district or upon any of the streets described in
said schedule.

Sec. 19-390. Parking time
limited on certain streets.
When signs are erected in each block giving notice thereof, no person shall park a vehicle
for longer than posted time between the hours indicated thereon of any day except Sundays
and public holidays within the district or upon any of the streets described in Schedule
D, of this chapter.

Sec. 19-391. Parking signs
required.
Whenever by this chapter or by any other ordinances of this municipality any parking time
limit is imposed or parking is prohibited on designated streets, it shall be the duty of
the traffic engineer to erect appropriate signs giving notice thereof, and no such
regulation shall be effective unless said signs are erected and in place at the time of
any alleged offense.

Sec. 19-392. Issuance of
parking tickets; penalties.
(a) A police officer may issue a parking ticket in lieu of a traffic citation form for
notifying alleged violators of Articles XII, XIII, XIV and XV.
(b) Such minor parking violators may waive being issued a traffic citation to appear in
the district court by paying to the city treasurer a fine of ten dollars ($10.00) for each
parking violation.
(c) All fines that remain unpaid thirty (30) days from the date the parking ticket is
issued, will automatically double.

Sec. 19-393. Impoundment of
motor vehicles for failure to pay parking tickets.
(a) Purpose. This section is enacted as an enforcement procedure for promotion and
protection of the public peace, safety and welfare, and the safeguarding of property, and
shall be used generally for the prevention and removal of traffic hazards, prevention and
abatement of public nuisances arising from traffic infractions, and for the protection of
the public rights in the use of city streets, thoroughfares, parking areas, parking lots,
and public ways.
(b) Procedure. As soon as a vehicle has been removed and stored or immobilized in place
under this section, the police officer or other municipal employee taking such action
shall so notify the police department dispatcher. Such information shall be recorded by
the dispatcher for the use of the chief of police or the finance director. In addition,
the chief of police shall notify by registered mail the registered owner of such vehicle
within five (5) business days of the impoundment of immobilization thereof. Said notice
shall state the location of such vehicle and the requirements for release as set forth in
this section.
(c) Release of vehicles. Any person having custody of a motor vehicle impounded pursuant
to this section or of the means to release such immobilized vehicle, shall not release it
until the individual requesting its release presents satisfactory evidence of his or her
right to possession and signs a receipt therefor. In addition, said vehicle shall not be
released until the finance director, the chief of police, or their duly authorized
representatives, certify that all waiver fees and all other charges provided for in this
ordinance have been paid, including all costs of impoundment, towing, notices and storage
or until the finance director, or duly authorized representatives, shall have certified
the posting of a bond equal to the total outstanding waiver fees which should have been
remitted for said overdue notices of violation and other charges as set forth in this
subsection.
(d) Bond. Whenever any person requests the right to post bond pursuant to this section,
such bond shall be given in cash and receipt given therefor. Such bond money shall be
refunded in the amount of the waiver fee for each alleged violation of this section upon
acceptance by such person of service of process initiating a court proceeding to determine
his or her liability for the described penalty or such alleged violation. Any bond shall
be forfeited unless the person posting it requests and accepts service of such process
from the chief of police or his or her designated representative within thirty (30) days
of posting unless prevented from doing so by actions or inactions of the City of Old Town.

Sec. 19-394. Handicapped
parking.
The traffic engineer may designate parking spaces for handicapped parking. Such spaces
shall be marked with a sign indicating such. Use of such spaces shall be restricted to
vehicles with handicapped parking passes as issued by the State of Maine or equivalent.
Fines for improper use of such spaces shall be set by the city council.

Schedule D - Parking
Generally
On any sidewalk, crosswalk or bridge.
Within ten (10) feet of any hydrant.
Within fifteen (15) feet of the driveway entrance to any fire station.
Theaters, no vehicle shall be allowed to stand whether occupied or not for more than three
(3) minutes between the hours of 1:00 p.m. and 12:00 p.m. directory in front of any
theater entrance.
At any place where official signs or curb painting so prohibits.
Within thirty (30) feet of any street corner.
Bosworth Street, on both sides, from Center Street to Chapman Street.
Center Street, on both sides, from Stillwater Avenue to Water Street.
Chester Street, on both sides, from Water Street to Main Street.
College Avenue, on both sides, from Old Mill Road to Stillwater Avenue.
Front Street, on both sides, from Center Street to Grays Lane.
Main Street, on both sides, from Wood Street to Chester Street, except in designated
parking spaces.
Oak Street, on both sides, from Seventh Street to the east driveway to Joseph A. Lenard
Junior High School.
Stillwater Avenue, on both sides, from the Stillwater River to the stream crossing
approximately eight hundred eighty (880) feet north of the College Avenue intersection.
Water Street, on both sides, from the north end at the Shop & Save parking lot to
Chester Street.
Willow Street, on both sides, from South Main Street to Brunswick Street.
Center Street on the north side, from Water Street to the Old Town-Milford line.
Middle Street, on the north side, from Shirley Street to Elm Street.
Brunswick Street, on the east side, from Pine Street to Willow Street.
Brunswick Street, on the east side, from Wood Street to Davis Street.
Stillwater Avenue, on the south side, from Brunswick Street to North Fourth Street.
Wood Street, on the south side, from Main Street to Brunswick Street.
Sawyer Street, on the south side, from South Water Street to South Main Street.

PARKING HOURS GENERALLY.
The hours of one and two (2) hour parking shall be in force from 8:00 a.m. to 6:00 p.m.
each day excepting Sundays and official holidays and also from 6:00 p.m. to 9:00 p.m. on
Friday night, but no person shall be deemed to have violated this rule who shall satisfy
the court that he is a physician or clergyman visiting the sick at the place of parking,
or that he is occupying a part of a public market place for a legally authorized purpose.

Main Street, on both sides, from Middle to Center Street.
Water Street, on both sides, from Center Street to Main Street.
Main Street, on the east side, from Center Street to the Shop & Save grocery store.
